A Magistrate court in Port Harcourt has remanded two pro-Biafra supporters in prison on a two count charge of conspiracy.

Friday Nwahiri, 54 and Enam David, 30 are accused of conspiring with a number of others to declare war against the Federal Republic of Nigeria.

Nwahiri and David are also being accused by the police of chanting war songs and disturbing public peace.

The Police in the charge further accused the suspects of committing an “offence punishable under Section 37 (1) and 37 (2) of the Criminal Code, Cap C38 Laws of the Federal Republic of Nigeria, 2004.”

Counsel to the accused persons, Echezona Mgbuoka had challenged the jurisdiction of the court to try the matter.

Presiding Magistrate, Senior Magistrate D.N Wanjoku referred the matter to the Department of Public Prosecution, DPP, for advise.

Counsel to the defendants told newsmen that “the police contravened the constitutional rights of the suspects.”
